These Terms & Conditions (“Terms”) govern your access to and use of https://proofofdate.io (the “Website”) and the services provided by IBEX Technology Ltd (“we”, “us”, “our”). By creating an account, using the service, or accessing the Website, you agree to these Terms. If you do not agree, you must not use the Website or services.

2. Eligibility
- The service is only available to users aged 18 years or older.
- By using the Website, you confirm that you are at least 18 years of age.
3. Our Service
- The Website allows users to create digital Proof of Dates by generating digital hashes (e.g. SHA256) of files or text.
- Users may optionally request that we store their files or entered text.
- When a Proof of Date is purchased, we mint a token on the Cardano blockchain containing the digital hash and any additional information you provide.
- Users can choose whether stored files/text are public (accessible by anyone) or private (accessible only to the user or their authorised persons).
4. Acceptable Use Policy
You agree to use the Website and our services only for lawful purposes and in accordance with these Terms. You must not:
4.1 Prohibited Content
Upload, submit, or store any files, text, or other material that:
- Is unlawful, defamatory, libellous, obscene, offensive, hateful, or discriminatory.
- Promotes violence, extremism, terrorism, or illegal activity.
- Infringes the intellectual property, privacy, or data protection rights of others.
- Contains malware, viruses, or any harmful code designed to disrupt or compromise systems.
4.2 Prohibited Conduct
Use of our Website or services in any of the following ways is strictly prohibited:
- Attempting to gain unauthorised access to accounts, systems, or networks.
- Interfering with, disabling, or disrupting the integrity or performance of the Website.
- Using automated scripts, bots, or scraping tools to access the Website in ways not authorised by us.
- Misrepresenting your identity, affiliation, or ownership of content.
- Using the services for high-risk purposes such as storing or transmitting highly sensitive personal information without appropriate safeguards.
4.3 User Representations and Content Rights
By posting files, text, or other material (the “Content”) on or through the our Website or services, you represent and warrant that:
- (i) the Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and
- (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, intellectual property rights, contract rights, or any other rights of any person or entity.
We reserve the right to terminate the account of anyone suspected of violating the foregoing representations in our sole and absolute discretion.
You retain any and all rights to any Content you submit, post, or display on or through the Service, and you are solely responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through the Service. However, by posting Content using the Service you grant us the right and license to use, modify, perform, display, reproduce, and distribute such Content on and through the Service as necessary to provide and operate the Service.
IBEX Technology Ltd. has the right, but not the obligation, to monitor all Content provided by users.
4.4 Enforcement
We reserve the right to:
- Remove or block access to any content that violates this Acceptable Use Policy.
- Suspend or terminate accounts involved in violations.
- Report illegal activity to law enforcement authorities.
5. File Storage and Data Integrity
- We will use reasonable care and commercially reasonable efforts to store your files and entered text for the duration you select.
- Storage is provided using our own servers and third-party providers.
- You acknowledge that despite our efforts, data loss or corruption may occur due to factors outside our control, including but not limited to hardware/software failure, third-party service failure, hacking, or other unforeseen events.
- To the fullest extent permitted by law, we shall not be liable for any loss, corruption, or unavailability of files or text, except where caused by our wilful misconduct or gross negligence.
- We will use reasonable efforts to ensure that files or text designated by you as “private” remain private. However, due to the nature of computer systems, third-party storage services, and the internet, we cannot guarantee that private content will never become publicly accessible. To the fullest extent permitted by law, we disclaim liability for any accidental disclosure of private content, except where caused by our wilful misconduct or gross negligence.
- Storage services are provided using third-party systems. While we select reputable providers, we are not responsible for failures, errors, or breaches of such third-party services.
- We strongly recommend that you retain your own backups of all files or text.
5.1 User Responsibility for Preserving Original Files
When storing your own copy of a file or text that has been hashed using the Service, you are solely responsible for ensuring that the file or text remains unaltered in any way. Even the smallest modification (including metadata changes or re-saving the file) will result in a different hash, and the original Proof of Date will no longer validate against the altered file. We disclaim liability for any mismatch or invalidation of a Proof of Date caused by your failure to preserve an exact copy of the original file or text.
5.2 Browser-Generated Hashes
You acknowledge that digital hashes of files or text are generated locally within your web browser. We do not control or verify the hash creation process within your device or browser environment. Accordingly:
- We are not responsible for any errors, corruption, or inaccuracies in hash values generated on your device.
- It is your responsibility to verify that any hash accurately represents your file or text when using the Service to create a Proof of Date. You can use any SHA256 hash generator on your file or entered text to do this.
- Except where caused by our wilful misconduct or gross negligence, we disclaim liability for any loss, error, or dispute arising from an incorrect or corrupted hash generated on your device.
5.3 URL Capture
If you use the Service to capture the content of a URL as an image file, you acknowledge and agree that:
- The captured image may not fully or accurately represent the content available at that URL at the time of capture, due to factors including (but not limited to) dynamic content, access restrictions, third-party scripts, geographic variations, or technical limitations.
- We make reasonable efforts to generate an accurate image but do not guarantee that the captured file will be complete, accurate, or identical to the original webpage.
- You are solely responsible for reviewing and verifying the accuracy of any captured image.
- Except where caused by our wilful misconduct or gross negligence, we disclaim liability for any errors, omissions, or discrepancies in a captured URL image, or for any reliance you place on such an image.
6. Accounts and Authentication
- Login is provided via an emailed link or a stored 1-click login link. You will not create or use a password.
- You are responsible for safeguarding your login link and must notify us immediately if you suspect unauthorised access to your account.
7. Payments and Subscriptions
- Payments are processed securely through Stripe.
- If you have an active subscription and fail to make payment, cancel your subscription, or delete your account, all files and text stored for you may be permanently deleted.
- Prices and subscription terms are displayed on the Website and may be updated from time to time. We reserve the right to change our prices, subscription fees, and payment terms at any time. Subscription users will be notified in advance of any changes to subscription pricing before such changes take effect. Any updated prices will take effect upon renewal of your subscription unless otherwise stated. Continued use of the Service after any price change constitutes your acceptance of the new pricing.
7.1 Credit Packs
When you purchase credit packs, the corresponding credit is added to your account for use within our services. All credit added through the purchase of credit packs must be used within 24 months from the date of purchase. Any unused credit after this period will automatically expire and will no longer be available.
No refunds are available once credit has been purchased, whether used or unused, except where required by applicable law.
8. Chargebacks and Payment Disputes
- You agree not to initiate chargebacks or payment reversals without first contacting us to resolve the issue.
- If a chargeback is initiated and found to be unfounded, you will be liable for:
- The original transaction amount;
- Any chargeback fees imposed by the payment processor;
- Our reasonable costs incurred in responding to and resolving the dispute.
 
9. Blockchain Records
- Proof of Date records minted on the Cardano blockchain are immutable and cannot be deleted or altered.
- You understand and accept that once submitted, this data is permanent.
9.1 Blockchain Minting Disclaimer
We will use reasonable efforts to process and submit your Proof of Date for minting on the Cardano blockchain. However, you acknowledge and agree that:
- Blockchain transactions depend on third-party networks and are outside of our direct control.
- We cannot guarantee that any transaction will be confirmed, successfully minted, or recorded in the blockchain within a specific time frame or at all.
- It is your responsibility to verify that your Proof of Date token has been successfully created and recorded on the Cardano blockchain after submission. A link is provided by us to a third party blockchain viewing service for you to do this once minting has been completed.
- Except where caused by our wilful misconduct or gross negligence, we shall not be liable for any failure, delay, or error in minting, or for any reliance you place on an unconfirmed or failed transaction.
10. Limitation of Liability
To the fullest extent permitted by law:
- We do not guarantee uninterrupted or error-free service.
- We are not liable for indirect, incidental, or consequential losses, including data loss, lost profits, or business interruption.
- Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the service in the 12 months preceding the claim.
11. Intellectual Property
- All intellectual property in the Website and services (excluding user-provided content) belongs to us or our licensors.
- You may not copy, modify, or distribute any part of the Website without our prior written consent.
12. Termination
- You may close your account at any time.
- We may suspend or terminate your account if you violate these Terms or if required by law.
- Upon termination, your stored files or text may be deleted.
13. Privacy
Your use of the Website is also governed by our Privacy Policy, which sets out how we handle your personal data.
14. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with the updated effective date. Continued use of the Website after changes are posted constitutes your acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
